Everyone knows the McDonald’s “hot coffee” case. It has been routinely cited as an example of how citizens have taken advantage of
America’s legal system, and as justification for the “tort reform” laws that put limits on people’s access to the courts.

The HBO documentary “Hot Coffee” reveals what really happened to Stella Liebeck, the Albuquerque woman who spilled coffee on herself and
sued McDonald’s, while exploring how and why the case garnered so much media attention, who funded the effort and to what end.

The Richard Linn American Inn of Court is please to advise you that, once again, it will award the Mark T. Banner Scholarship for law students.
In 2011, the Inn’s founder, United States Court of Appeals Judge Richard Linn, recognized two scholarship recipients at its annual black tie dinner of the Inn in Chicago.
This year, the Inn anticipates doing so again.

The scholarship is open to all students currently enrolled in a J.D. program at an ABA accredited law school and who will continue in that program through the fall semester 2012.
An ability to demonstrate the commitment to the pursuit of a career in intellectual property law is an essential requirement.
The applicant must have exemplary writing and oral communication skills.
Diversity is considered, but is also one element among several in the award decision.

Applications are being taken now and are due no later than November 11, 2011.

New Industrial Microwaves in the Sidebar!

The Dean has graciously bought replaced our broken microwaves (which were only about a year old!) with four new industrial-strength microwaves! These microwaves are extremely expensive and the school cannot afford to replace the microwaves every year, so PLEASE use them appropriately.

This means COVER YOUR FOOD with paper towel and DO NOT microwave metal of any kind. You may think that your one little bowl of ravioli isn’t going to hurt the microwave, but you could be costing the school hundreds of dollars in damage. Individuals caught misusing the microwaves may be asked not to use the microwaves. Please contact Michelle Yun (myun@wisc.edu) with any questions. Thanks!

CLS Guest Speaker: Attorney Taqwanya Smith

CLS is happy to welcome back CLS Alumni Taqwanya Smith (Class of 1999). Attorney Smith received her law degree from the University of Wisconsin Law School, and her undergraduate degree from Florida A&M University. Attorney Smith will be discussing her career, and growing in maintaining faith while in law school and throughout your legal career.

Attorney Smith is a Senior Policy Analyst for the Wisconsin Department of Transportation. She works to ensure that the Department meets federal civil rights requirements in highway projects, public facilities and public services. She has worked for the Department since 2005.

Prior to her career with the Department of Transportation, she worked for the State Public Defender’s Office, as well as a non-profit called Community Adolescent Programs. Additionally, she has worked with such commissions as the Commission on Reducing Racial Disparities in the Wisconsin Criminal Justice System, Traffic Stop Data Collection Advisory Committee (Racial Profiling), and the Council on Offender Reentry.

Animal Law Volunteer Opportunities

Courtesy Student Animal Legal Defense Fund (SALDF)

1. Local attorney Stacy Taeuber is looking for volunteers to look into legal issues surrounding killing of geese by the city of Madison. This may involve legal research or FOIA requests. Email Stacy directly at taeuberlaw@gmail.com if you are interested in assisting.

2. The Florida-based Big Cat Rescue has been tracking abusive traveling animal shows and alerting local police to statutory violations. Volunteers who would be interested in looking up statutes and theorizing on what laws would be effective in curbing these abuses should contact Colleen at cfinney@wisc.edu.

Informal Talk with Senior Judges from Shanghai, China

All the law students:

As you probably already know, there are a group of senior judges from Shanghai now visiting our law school for about 2 weeks. Most of the judges are sitting in the local trial courts of different district court of Shanghai, and at least are associate-chief judges of their own courts; some other are from the appellate courts and the high court of Shanghai. Other than having lectures and meeting various members of the law community of Madison and Wisconsin, the judges are very interested in communicating with law students who are studying in this prominent law school. I think this would be a great opportunity for those who are interested in Chinese judicial system and in people who are really working there. Shanghai is one of the most developed areas of China, therefore the judicial practice in this area will usually have a national influence.

On October 6, 2011, the University of Wisconsin Law School and the Law School’s Program in Real Estate, Land Use, and Community Development are cosponsoring an event which will bring Professor Elinor Ostrom to the Law School.

Professor Ostrom is a 2009 Nobel Prize winner in Economic Sciences. Professor Ostrom studies issues with respect to the commons, including collective action issues which arise in managing common-pool resources.

The program will occur from 12:30-2:00 p.m. in Lubar Commons. As Professor Ostrom will be delivering the Hilldale Lecture at 3:00 p.m. on October 6th at the Wisconsin Institute for Discovery, she will not be giving a separate lecture at the Law School. Instead, we will host apanel discussion in which four panelists will each discuss how common-pool resource issues are relevant in his or her field and how law and policy have/have not or should/should not develop to address such issues. The four panelists are as follows:

Professor Daniel Bromley (Department of Agriculture and Applied Economics)
Professor Neil Komesar (Law School)
Professor Stephen Malpezzi (Business School)
Professor Melissa Scanlan (Law School and the University of
Wisconsin-Milwaukee’s School of Freshwater Sciences).

Each of the panelists will speak for ten minutes. Professor Ostrom will then spend twenty minutes responding to the panelists’ presentations. We have reserved twenty minutes for questions from the audience.

Interested in Being A Mentor? Students for Equal Access to Law School (SEALS) is looking for mentors for their Mentorship Program!
Students for Equal Access to Law School (SEALS) is seeking law school mentors for their undergraduate student mentees. This is a great program that was started last year. Lets keep it going by having interested LEO students participate. A mentor’s commitment includes communicating with your mentee often, taking them out to lunch 1x/semester, and answering any questions they may have about law school. A stipend is given to each mentor to cover the costs of taking your mentee out to lunch, or coffee.

SEALS is an undergraduate organization dedicated to providing resources for, but not exclusively to, underrepresented minority students at the University who are interested in law and/or a legal career, as well as anyone interested in minority legal issues.

Informal Talk with Senior Judges from Shanghai, China

All the law students:

As you probably already know, there are a group of senior judges from Shanghai now visiting our law school for about 2 weeks. Most of the judges are sitting in the local trial courts of different district court of Shanghai, and at least are associate-chief judges of their own courts; some other are from the appellate courts and the high court of Shanghai. Other than having lectures and meeting various members of the law community of Madison and Wisconsin, the judges are very interested in communicating with law students who are studying in this prominent law school. I think this would be a great opportunity for those who are interested in Chinese judicial system and in people who are really working there. Shanghai is one of the most developed areas of China, therefore the judicial practice in this area will usually have a national influence.

On October 6, 2011, the University of Wisconsin Law School and the Law School’s Program in Real Estate, Land Use, and Community Development are cosponsoring an event which will bring Professor Elinor Ostrom to the Law School.

Professor Ostrom is a 2009 Nobel Prize winner in Economic Sciences. Professor Ostrom studies issues with respect to the commons, including collective action issues which arise in managing common-pool resources.

The program will occur from 12:30-2:00 p.m. in Lubar Commons. As Professor Ostrom will be delivering the Hilldale Lecture at 3:00 p.m. on October 6th at the Wisconsin Institute for Discovery, she will not be giving a separate lecture at the Law School. Instead, we will host apanel discussion in which four panelists will each discuss how common-pool resource issues are relevant in his or her field and how law and policy have/have not or should/should not develop to address such issues. The four panelists are as follows:

Professor Daniel Bromley (Department of Agriculture and Applied Economics)
Professor Neil Komesar (Law School)
Professor Stephen Malpezzi (Business School)
Professor Melissa Scanlan (Law School and the University of
Wisconsin-Milwaukee’s School of Freshwater Sciences).

Each of the panelists will speak for ten minutes. Professor Ostrom will then spend twenty minutes responding to the panelists’ presentations. We have reserved twenty minutes for questions from the audience.

What is the Dane County Time Bank Youth Court?

This program sends high school students, who are in trouble, to a jury of their peers who sentence them. This is an alternative to the youth going through the juvenile court system. The peer jury usually comes up with a sentence such as requiring that person to participate on the jury or take part in community service activities that can help them succeed in the long run and get off a path of trouble. Unemployment Appeals Clinic (UAC)

Training

This Tuesday, 9/20 5:40-7:40pm in 5223 (new advocates must attend this session)

The Unemployment Appeals Clinic is open to ALL Law Students, including 1Ls!

o Get valuable clinical litigation experience

o Develop skills in client counseling and administrative hearing advocacy

o Draft an appellate brief to the Labor and Industry Review Commission

o Provide much-needed representation to low-income clients

o Work with experienced supervising attorneys from the Madison area

o Minimal Time Commitment: 6-12 hours per semester

Student advocates attend training, then conduct intake sessions with clients who are Madison-area workers seeking unemployment compensation benefits. You will work with real clients and have a hands-on opportunity handling cases from intake through hearing. Continuous Change and Improvement: Some Lessons from Contemporary International Development Planning

Planners are trained and oriented to do more than simply “do no harm” but instead seek effective ways to improve people’s lives. In the field of international development planning today there are a rich assortment of ideas to eradicate poverty and improve the lives of the world’s poor. There are also unprecedented opportunities to build on recent successes and to learn from past failures. From the front lines of development in a middle income country, Indonesia, itself in the center of Asia, the fastest growing region of the world with over half the world’s total population, what lessons might be learned from efforts to implement these changes so that they are more likely to succeed and accelerate sustainable and more equitable growth?

On October 6, 2011, the University of Wisconsin Law School and the Law School’s Program in Real Estate, Land Use, and Community Development are cosponsoring an event which will bring Professor Elinor Ostrom to the Law School.

Professor Ostrom is a 2009 Nobel Prize winner in Economic Sciences. Professor Ostrom studies issues with respect to the commons, including collective action issues which arise in managing common-pool resources.

The program will occur from 12:30-2:00 p.m. in Lubar Commons. As Professor Ostrom will be delivering the Hilldale Lecture at 3:00 p.m. on October 6th at the Wisconsin Institute for Discovery, she will not be giving a separate lecture at the Law School. Instead, we will host apanel discussion in which four panelists will each discuss how common-pool resource issues are relevant in his or her field and how law and policy have/have not or should/should not develop to address such issues. The four panelists are as follows:

Professor Neil Komesar (Law School)
Professor Stephen Malpezzi (Business School)
Professor Melissa Scanlan (Law School and the University of

This program sends high school students, who are in trouble, to a jury of their peers who sentence them. This is an alternative to the youth going through the juvenile court system. The peer jury usually comes up with a sentence such as requiring that person to participate on the jury or take part in community service activities that can help them succeed in the long run and get off a path of trouble. Students for Equal Access to Law School (SEALS) is seeking law school mentors for their undergraduate student mentees. This is a great program that was started last year. Lets keep it going by having interested LEO students participate. A mentor’s commitment includes communicating with your mentee often, taking them out to lunch 1x/semester, and answering any questions they may have about law school. A stipend is given to each mentor to cover the costs of taking your mentee out to lunch, or coffee.

SEALS is an undergraduate organization dedicated to providing resources for, but not exclusively to, underrepresented minority students at the University who are interested in law and/or a legal career, as well as anyone interested in minority legal issues.

Unemployment Appeals Clinic (UAC) Training

Friday 9/16 12:00-2:00pm in 3260 and Tuesday 9/20 5:30-7:30pm in 5223 (new advocates must attend one of these training sessions)

The Unemployment Appeals Clinic is open to ALL Law Students, including 1Ls!

o Get valuable clinical litigation experience

o Develop skills in client counseling and administrative hearing advocacy

o Draft an appellate brief to the Labor and Industry Review Commission

o Provide much-needed representation to low-income clients

o Work with experienced supervising attorneys from the Madison area

o Minimal Time Commitment: 6-12 hours per semester

Student advocates attend training, then conduct intake sessions with clients who are Madison-area workers seeking unemployment compensation benefits. You will work with real clients and have a hands-on opportunity handling cases from intake through hearing. SBA’s Commencement Speaker Selection Committee will be taking nominations from 3Ls for this years Commencement Speaker! This is for the non-faculty speaker. Nominations for the Faculty Speaker will be taken later in the year, as will nominations for student speakers.

SBA will be taking nominations for the commencement speaker from now until this Thursday, September 15. The Committee will then pare down the list to a reasonable number of names and solicit the students body’s preference through an email survey at a later date. The administration will then use this list to begin extending invitations to potential speakers.
